JUSTICE SANJAY PRIYA ORAL ORDER 07-03-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Sandesh P.S. Case 03 of 2016 instituted for the offence under Sections 304(B), 201 and 34 of the Indian Penal Code.

It has been submitted that the petitioner is brother-inlaw (Bhainsur) of the deceased. The husband of the deceased Laxmi Choudhary has not been made accused in this case. It has further been submitted that father-in-law has already been granted bail by a coordinate Bench of this Court vide order dated 30.1.2017 passed in Cr. Misc. 43069 of 2016.

From the written report it appears that there is general and omnibus allegation against the petitioner. The petitioner is said to be in custody since 3.7.2016.

Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate IXth, Bhojpur at Ara, in connection with Sandesh P.S.
