The petitioner seeks bail in a case registered for the offence punishable under Sections 147, 148, 149, 307, 324, 353, 435, 379, 427, 302 of IPC, 27 of the Arms Act, 3⁄4 of Explosive Substances Act, 17 of Criminal Law Amendment Act and 10 of Unlawful Activities (Prevention) Act, 1967.
It is submitted that the petitioner is not named in the FIR. His name has appeared during investigation on the confessional statement of co-accused Rajendra Yadav and later on, he has also made confession before the police. It is further submitted that in similar facts and circumstances, co-accused Sridhar Pathak has been granted bail by this Court vide Cr. Misc.
Patna High Court Cr.Misc. No.27666 of 2015 (2) dt.03-08-2015 2/2 No. 41322 of 2014 (Annexure-2-B). No incriminating article has been recovered from the possession of the petitioner. Learned counsel for the State submits that the petitioner has also criminal antecedents.
Considering the facts and circumstances, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand only) with two genuine sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad/court concerned after framing of charge in Goh P. S. Case No. 140 of 2013 with following conditions:-
1. The petitioner will not indulge himself in similar or any other offence.
2. The petitioner will be well represented in the Court on each and every date and in case of absence for two consecutive dates or in case of violation of terms of bail, his bail bond would be liable to be cancelled by the learned Court concerned.
