The petitioner seeks bail in a case registered under Sections 302/201/120(B) of the Indian Penal Code. As per the allegation, eight persons and two unknown persons came to the house of the informant and took the brother of the informant, namely, Baleshwar Yadav, from his house along with them and subsequently after 3-4 hours when the informant came out of his house he saw that a tempo is coming towards him and the dead body of his brother was thrown and he identified the accused persons in light of the tempo and with the help of the street light.
It is contended that none had seen the petitioner having
Patna High Court Cr.Misc. No.42707 of 2016 (2) dt.06-10-2016 taking part in the murder of the brother of the informant. It is further contended that some of the accused persons who are similarly situated have been granted anticipatory bail and regular bail by different Coordinate Benches of this Court, copies of which have been appended as Annexure 2 series. Having regard to the facts and the circumstances of the case, the petitioner, Chandan Singh @ Chandan Kumar, is directed to be released on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Lakhisarai, in connection with G.R. Case No. 1753/2015 arising out of Piri Bazar Police Station Case No. 61/15.
