The petitioner seeks bail in Saharsa Sadar P.S. Case No. 133 of 2015, registered for the offences punishable under Sections 418, 419 and other Sections of the Indian Penal Code. The police recovered a stolen motorcycle from near the house of the petitioner. It is alleged that the petitioner along with co-accused committed theft of the motorcycle. It is submitted that nothing has been recovered from the conscious possession of the petitioner.

From perusal of the seizure list it would appear that the motorcycle was not recovered from the house of the petitioner, but the same was recovered from near the house of the petitioner. The petitioner is in jail since 04.03.2015 and has got no criminal

Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa in Saharsa Sadar P.S.
