This application for regular bail arises out of Chandi P.S. Case No. 147 of 2018, disclosing offence punishable under Sections 341, 323, 307, 504 and 120(B) of the Indian Penal Code.

The petitioner's prayer for grant of regular bail was rejected twice, firstly, by an order dated 08.07.2020 passed in Cr. Misc No. 4611 of 2020 and secondly, by an order dated 28.07.2021 passed in Cr. Misc. No. 18199 of 2021. Learned counsel for the petitioner has submitted that the petitioner is in custody since 22.11.2019. Earlier by an order dated 30.11.2022, a report was called for as regards present

Patna High Court CR. MISC. No.59364 of 2022(5) dt.25-01-2023 2/2 stage of the trial from the court of learned Additional Chief Judicial Magistrate. A report has been received from which, it appears that the case is still pending for commitment. The case has been recently committed to the Court of Sessions on 14.12.2022.

Considering the circumstance that the petitioner is in custody since 22.11.2019 and the trial has not even begun, in my opinion a case is made out directing release of the petitioner on bail. This application is allowed.

Let the petitioner, Sanjay Yadav @ Sanjay Kumar, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), each with two sureties of the like amount, each to the satisfaction of learned Additional Chief Judicial Magistrate or Successor Court, Bhojpur, Arah, in Chandi P.S. Case No. 147 of 2018.
