This is an application for bail in connection with Gopalganj P.S. Case No. 244 of 2017 registered for the offences punishable under Section 414 of the Indian Penal Code. Allegation against the petitioner is of recovery of one motorcycle from his possession.

Submission of learned counsel for the petitioner is that nothing has been recovered from his conscious possession, rather the same is recovered from orchard and he was passing through the orchard. Further submission is that he is in custody for more than two months having no criminal antecedent. Heard learned APP also.

Having heard both sides and in view of allegation, I am

Patna High Court Cr.Misc. No.41273 of 2017 (2) dt.07-09-2017 2/2 not inclined to grant bail to the petitioner at this stage. However, this application is disposed of with a direction to the court below that once charge has been framed against the petitioner in this case or petitioner completes four months period in custody, the court below will release him on bail to its satisfaction.
