2. The petitioner seeks regular bail in connection with Agamkuan P.S. Case No. 694 of 2023, registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.
3. As per Prosecution, 55 litres of country made liquor has been recovered from the possession of the petitioner. Petitioner has no criminal antecedent and he is in judicial custody since 18.07.2023.
4. Learned APP has vehemently opposed the prayer for bail.
5. Considering the fact that there is no direct evidence against the petitioner, this application is allowed.
6. Let the petitioner, above named, be released on bail
Patna High Court CR. MISC. No.56990 of 2023(2) dt.30-08-2023 2/2 on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge- Excise, Patna City, Patna in connection with Agamkuan P.S. Case No. 694 of 2023.
7. This is also subject to the condition that the petitioner shall mark his presence in Agamkuan Police Station, District- Patna on first Sunday of every month, failing which, his bail bonds shall be cancelled by the court below. (Sandeep Kumar, J) Ranjeet/- U T
