JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-10-2017 Heard learned counsel for the petitioner and Mr. Akhileshwar Prasad Singh, Senior Advocate for the Economic Offence.

This is an application for bail in connection with Economic Offence P.S. Case No. 13 of 2017 registered for the offences punishable under Sections 420, 467, 120(B) and 34 of the Indian Penal Code.

Allegation against the petitioner is of displaying in website, without any interview his company selected 151 candidates and taken Rs.15,800/-. He is said to be Chairman of that Company. Further allegation that they are inducing the persons in various ways and collecting money. Police raided the office of Company

Patna High Court Cr.Misc. No.47073 of 2017 (3) dt.17-10-2017 2/2 and he was arrested by the police.

Submission of learned counsel for the petitioner is that he has falsely been implicated in this case. He is only Peon in Company and is in custody since 10.8.2017.

Heard learned APP and learned Senior counsel for the Economic Offence. They have opposed the prayer of the petitioner.

Having heard both sides and in view of the facts and circumstances, I am not inclined to grant bail to the petitioner at this stage. However, once charge has been framed in this case, the trial court shall release the petitioner on bail to his own satisfaction.
