The petitioner is languishing in custody since 23.02.2016 in connection with Kanhauli P.S. case No.17 of 2016 for the offences instituted under Sections 363 and 366A/34 of the I.P.C.

Allegation against the accused persons including the petitioner is of abducting the elder daughter of the informant. It has been submitted on behalf of the petitioner that the petitioner is in custody since 23.02.2016 and the charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The victim has been

Patna High Court Cr.Misc. No.25617 of 2016 (3) dt.24-08-2016 2/2 examined under Section 164 Cr.P.C. where she has admitted that she had left her house on her own will and she has married this petitioner.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Kanhauli P.S. case No.17 of 2016.
