Petitioner apprehends his arrest in a case registered for the offence punishable under Section 307, 379 and some other minor Sections of the Indian Penal Code. As per the prosecution case, this petitioner is alleged to have assaulted the informant with knife on his head. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. There is land dispute between the parties and Title Suit No. 61/2021 is going on between them and a proceeding u/s 107 of the Cr. P. C has also been initiated. The injury is reported to be simple in nature. Petitioner has got clean antecedent.

No.66125 of 2021(3) dt.29-08-2022 2/2 Learned counsel appearing for the State and the informant opposed the prayer for anticipatory bail and submitted that there is direct and specific allegation against this petitioner that he assaulted the informant with knife on his head. Considering the facts of the case, nature of accusation and clean antecedent of the petitioner, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-IV, Samastipur in connection with Mohiuddin Nagar PS case No.207/ 2021, subject to conditions laid down u/s 438(2) of the Cr. P. C.
