Petitioner is in custody in connection with Mairwa P.S. Case No. 177 of 2019 for the offence under section 30(a) of Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner would submit that petitioner has no criminal antecedent.

In the instant case total 49 liters of foreign liquor was seized in front of the house of the petitioner. Learned counsel for the petitioner submits that petitioner is in custody since 6.7.2019.

Considering the fact that petitioner has no criminal antecedent, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be enlarged on bail on

No.52165 of 2019(2) dt.22-08-2019 2/2 furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Excise, Siwan, in connection with Mairwa P.S. Case No. 177 of 2019 subject to the condition that petitioner shall deposit Rs. 25,000/- (Twenty Five Thousand) cash in the court below which shall be abide by final outcome of the pending criminal case i.e. in the event of acquittal the amount shall be refunded to the petitioner otherwise the amount shall be forfeited.
