JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 06-02-2023 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Rajgir P.S. Case No. 76 of 2022, registered for the offences punishable under Sections 25(1-aa)m 26(i) (ii)m 35 Arms Act. As per allegation, one co-accused Amit Vishwakarma was also accused in Rajgir P.S. Case No. 73 of 2022. He was arrested and he apprised the police party that in the house of the petitioner, the articles to manufacture illegal arms might be recovered. Thereafter, the house of the petitioner was raided and huge number of articles for manufacturing arms, detailed in the FIR, have been recovered. A gun and some cartridges were also

The learned counsel for the petitioner has submitted that the house wherefrom the articles for manufacturing illegal arms were recovered, was joint house of the petitioner and he is not the exclusive owner of that house.
At the confessional statement of co-accused, the house of the petitioner was raided. A number of articles mentioned in the FIR were recovered, which shows that a factory of gun of manufacturing illegal arms was run in the house of the petitioner.
In my view, it is not a fit case for anticipatory bail. Accordingly, it is rejected.
