Petitioner seeks bail in a case registered under sections 272, 273 of the Indian Penal Code and 47A of the Excise Act. 62 liters semi prepared country made liquor and 22 liters country made liquor and other apparatus are said to have been recovered from the house of the petitioner.

Submission on behalf of the petitioner is that seizure list witnesses have filed a petition mentioning therein that nothing has been recovered from possession of the petitioner. It is further submitted that even if the aforesaid recovery assumed to be true, then also, said recovery has been made from joint house. It is also submitted that petitioner does not have any criminal antecedent and is languishing in jail custody since 20.4.2016.

Patna High Court Cr.Misc. No.36406 of 2016 (2) dt.30-08-2016 Considering the period of detention of the petitioner in jail custody as well as his antecedent, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate, Purnea in Dhamdaha P.S. Case no. 74/2016.
