The petitioner is languishing in custody since 08.12.2014 in a case registered for the offences punishable under Section 394 of the Indian Penal Code.
The miscreants robbed two thousand rupees and motorcycle of the informant leading to the registration of the case against three unknown persons.
Name of the petitioner sprang up on the confession of Niraj Kumar Yadav, from whom the motorcycle of the informant was recovered, but Niraj Kumar Yadav has been granted bail vide Cr. Misc. No. 50029 of 2014. It is submitted by learned counsel for the
Patna High Court Cr.Misc. No.15341 of 2015 (02) dt.22-06-2015 2/2 petitioner that the petitioner has not been put on TIP, though, statement to that effect has not been made in the petition. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent and application filed by the informant to the effect that the petitioner is known to the informant from before and was not involved in the crime, has been brought on record as Annexure-2.
Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Bhargama P.S. Case No. 134 of 2014. (Dinesh Kumar Singh, J) DKS/- U T
