JUSTICE SUDHIR SINGH ORAL ORDER 26-10-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Sections 147, 149, 341,323, 324, 448, 379, 386, 436, 504, 506 of the I.P.C. and Section 27 of the Arms Act. Allegation is that the accused persons including the petitioner made indiscriminate firing on the informant, which hit in his right hand and accused Arun Sah sprinkled kerosene oil in his house and petitioner set his house on fire by match-stick. It has been submitted on behalf of the petitioner that the petitioner is in custody since 25.7.2016 and the charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The witnesses in course of

Patna High Court Cr.Misc. No.36463 of 2016 (3) dt.26-10-2016 investigation have not supported the allegations for offence under Section 436 of the I.P.C. The petitioner has falsely been implicated in the present case.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Saurbazar P.S. case No.337 of 2015.
