JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 22-06-2015 Heard learned counsel for the petitioner and Mr. Ramchandra Singh learned APP for the State.

The sole petitioner seeks bail in Belaganj P.S. Case No. 89 of 2014 initially registered under section 307 IPC but latter section 302 was added. On account of uprooting pillars from the field, it is alleged, the occurrence had taken place in which six accused persons conjointly assaulted the father of the informant as a result of which he died subsequently.

Learned counsel for the petitioner submits that owing to land disputes the occurrence had taken place. There is general and omnibus allegation against all the six accused persons. The petitioner is in custody since 29.06.2014 having no criminal antecedent.

Patna High Court Cr.Misc. No.14869 of 2015 (3) dt.22-06-2015 2 / 2 Mr. Singh learned APP, on the other hand, points out that other co accuseds of the present case moved this court by filing Cr. Misc. No. 42459 of 2014. This Court while declining the prayer granted them liberty to renew their prayer for bail after six months.

Having regard to the aforesaid, this Court while declining the prayer for bail permits the petitioner to renew his prayer for bail after four months from the date of receipt/production of a copy of this order in the court below. (Kishore Kumar Mandal, J) HR/- U
