The petitioner seeks bail in Chakia P.S. Case No. 124 of 2019 instituted for the offence under Sections 399, 402 and 412 of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act.

It is alleged that police got information that few persons have assembled to commit crime. Total six persons were apprehended. It is further alleged that one motorcycle bearing Registration No. BR05AE4527 has been recovered from possession of petitioner that also stands in his name, as per the copy of the Registration Certificate, which is placed on record as Annexure-2 to bail application.

Having considered the rival submissions of the parties, prayer for bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, East Champaran at Motihari in connection with Chakia P.S. Case No. 124 of 2019, subject to the following conditions:- (i) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(ii) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail bond will be liable to be cancelled.
