JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-06-2015 Heard learned counsels for the petitioner and the State. The petitioners are languishing in custody since 23.06.2014 in a case registered for the offences punishable under section 307 of the Indian Penal Code and Section 27 of the Arms Act.
It is alleged that miscreants came on two motor cycles and made indiscriminate firing on the informant though he did not receive any injury. The first information report was lodged against unknown but the name of petitioners sprang up during investigation. Statement has been made in paragraph 11 that the petitioners have not been put on T. I. parade and similarly situated
Patna High Court Cr.Misc. No.16921 of 2015 (2) dt.22-06-2015 2/2 co-accused, Sanni Singh and Dipu Singh have already been grated bail by this court in Cr. Misc. No. 14325 of 2015. Considering the aforesaid facts, let the above named petitioners be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Sikarahana at Motihari, East Champaran in connection with Madhuban P. S. case No. 18 of 2014.
Considering the criminal antecedent of the petitioners, the learned court below shall be at liberty to cancel the bail bonds of the petitioners in case the petitioner get involved in serious offence or defaults without any reasonable cause on three consecutive occasions.
