Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. One loaded country made pistol and one live cartridge were recovered from conscious possession of the petitioner when petitioner and others were caught by the police. The informant claims that petitioner and his associates had assembled to make preparation for committing dacoity. Petitioner is in jail custody since 12.03.2016 and except the present case as well as Bhagawanpur Hatt P.S.Case No. 13 of 2016, petitioner does not have any criminal antecedent.

Patna High Court Cr.Misc. No.38916 of 2016 (2) dt.20-09-2016 2/2 Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Session Judge 5th, Siwan in connection with Bhagawanpur Hatt P.S.Case No. 48 of 2016.
