JUSTICE SUDHIR SINGH ORAL ORDER 30-08-2019 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant. The petitioner seeks bail in a case registered under Section 302/34 of the Indian Penal Code.

Allegation is that the accused persons including the petitioner assaulted the sister of the informant with fat, fist and leg and co-accused Pir Mohammad pressed the neck of informant's sister, due to which she died.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 2.6.2019 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is the mother-inlaw of the deceased. She is separate in mess and property from

Patna High Court CR. MISC. No.54696 of 2019(2) dt.30-08-2019 2/2 the husband of the deceased. The husband of the deceased is in custody. The petitioner has got no concern with alleged occurrence.

On behalf of the State and learned counsel for the informant, it is submitted that the petitioner is named in the complaint case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Turkaulia (Banjaria) P.S. case No.340 of 2019.
