Patna High Court CR. MISC. No.66399 of 2021(3) dt.21-09-2022 2/3 Heard the learned counsel for the petitioners and learned APP for the State.
The petitioners apprehend their arrest for the offences alleged under Sections 341, 323, 308, 379, 325 and 504 of the Indian Penal Code, registered in connection with Barh P.S.Case No. 60 of 2021.
As per allegation, the accused persons including the petitioners assaulted the informant and his son Ravi Shankar Prasad. The informant suffered fracture injury in his right hand. His son also suffered injury on his head. The petitioners Bikrant @ Vikrant Kumar and Vikas @ Vicky Kumar snatched the gold chain from his neck.
The learned counsel for the petitioners has submitted that there is case and counter case and both the parties have suffered injuries. It is free fighting between the two groups on trivial issue of quarrelling of children. He has submitted further that exactly on similar footing co-accused Ranjit Ram has been granted anticipatory bail by a coordinate Bench of this Court in Cr.Misc. No. 43582 of 2021. The petitioners are the persons of clean antecedent.
On the other hand, the learned APP for the State has opposed the prayer for anticipatory bail and submitted that the
Patna High Court CR. MISC. No.66399 of 2021(3) dt.21-09-2022 3/3 informant has suffered grievous injuries.
Considering the above facts and circumstances and also considering that co-accused Ranjit Ram has been granted anticipatory bail on similar footing by a coordinate Bench of this Court, let the petitioners of both the cases, above-named, in the event of their arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each, with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate,1, Barh, Patna in connection with Barh P.S.Case No. 60 of 2021, subject to the conditions as laid down under Section 438(2) Cr. P.C. Office shall ensure that all defects are removed by the petitioners within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
