JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 03-04-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner had obtained twice the amount allotted for Indra Awas Yojna which was subsequently been allotted to her. The petitioner has fairly submitted that being a rustic lady she was not aware as the earlier grant received by her happens to be of Financial Year 2002-03. It has also been submitted that she is ready to deposit rupees fifty thousand received by her during Financial Year 2013-14.
Learned Additional Public Prosecutor opposed the prayer and submitted that mere deposit of amount will not exonerate the petitioner from her charges.
Be that as it may, on deposit of rupees fifty thousand,
Patna High Court Cr.Misc. No.39597 of 2014 (3) dt.03-04-2015 P2/2 petitioner Punam Devi, in the event of her arrest / surrender within four weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad, in connection with Aurangabad (M) P.S. Case No. 164/2014, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
It is made clear that the deposit will not be considered as an admission during the course of trial.
