22-10-2016 Heard Sri Arvind Kumar, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody in Kudra P.S. Case No. 234 of 2016 registered for offence under Sections 47(A), 54 & 63 of the Bihar Excise (Amendment) Act, 2016, has prayed for grant of bail.
It was submitted by learned counsel for the petitioner that petitioner was not arrested from the place of occurrence, rather his name has come on the basis of confessional statement of one of the co-accused, who disclosed that petitioner was also associated with him in selling the liquor. He submits that recovery of huge quantity of foreign liquor was effected from the shop of one Kanhaiya Mali and Anand Kumar. By way of referring to statement made in paragraph - 3 of the petition, he submits that
Patna High Court Cr.Misc. No.45715 of 2016 (2) dt.22-10-2016 2/2 petitioner is having clean antecedent.
Keeping in view nature of accusation, period of custody and clean antecedent of the petitioner, let the petitioner namely Bittu Mali be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabhua in connection with Kudra P.S. Case No. 234 of 2016.
