The petitioner seeks regular bail in connection with Gaurichak P.S.Case No.73 of 2017 of 2017 registered for offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

Allegation against the petitioner is about recovery of 314 bottles of foreign liquor.

Submission of the learned counsel for the petitioner is that the petitioner has been falsely implicated in this case. The petitioner has no criminal antecedent and he is in custody since 6.7.2017.

Heard learned A.P.P. also.

Having heard both sides and in view of allegation, this application is disposed of with direction that once the charge

Patna High Court Cr.Misc. No.46238 of 2017 (2) dt.19-09-2017 is framed or he completes three months more period in judicial custody, whichever is earlier, the learned court below shall release the petitioner in connection with Gaurichak P.S.Case No.73 of 2017 (Special Case No.1078 of 2017).

With the aforesaid observation, this application is disposed of.
