Petitioners apprehend their arrest in a case registered for the offence punishable under Section 406, 420, 323 and some other ancillary Sections of the Indian Penal Code. As per the prosecution case, these petitioners along with other accused persons got deposited Rs. 10 Lakh from the informant in the Drum Sanndhi Money Master Enterprises and when the money was not returned the informant sent legal notice to co-accused, Jitendra Kumar. On receipt of legal notice the accused persons, including these petitioners, came to the

Patna High Court CR. MISC. No.65982 of 2021(2) dt.14-07-2022 2/2 informant and threatened him of dire consequences. Learned counsel appearing for the petitioners submits that petitioners are innocent and have falsely been implicated in the case. It is submitted that specific allegation is against coaccused, Ramesh Kumar and Jitendra Kumar and petitioner No.2 is uncle of Ramesh Kumar and father of Jitendra Kumar whereas petitioner No.1 is cousin of Ramesh Kumar and brother of Jitendra Kumar. There is no allegation that petitioners have received any farthing. Petitioners have got clean antecedent. Learned counsel appearing for the State opposes the prayer for anticipatory bail.

Considering the facts of the case and clean antecedent of the petitioners, let the petitioners, above named, in the event of their arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Lakhisarai in connection with Lakhisarai PS case No. 705/2019, subject to conditions laid down u/s 438(2) of the Cr.
