JUSTICE SUDHIR SINGH ORAL ORDER 04-10-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Section 47 (A) of the Bihar Amended Excise Act. Allegation is that from the Dalan of petitioner foreign liquor has been recovered.

It has been submitted on behalf of petitioner that he is in custody since 12.8.2016. Petitioner has got no criminal antecedent. No allegation of tampering of witnesses is alleged against petitioner. Alleged recovery of foreign liquor is denied by petitioner. There is no compliance of Section 100 of the Code of Criminal Procedure.

On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond

Patna High Court Cr.Misc. No.42386 of 2016 (2) dt.04-10-2016 2/2 of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Siwan, in connection with Andar/M.H. Nagar P.S. Case no. 93 of 2016.
