ANJANA MISHRA ORAL ORDER 25-03-2015 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners in both the applications are apprehending their arrest in connection with Sheohar P.S. Case No. 24 of 2014 registered under sections 447, 341, 323, 332, 333,

Patna High Court Cr.Misc. No.40102 of 2014 (2) dt.25-03-2015 353, 379, 504 and 506/34 of the Indian Penal Code. It is submitted on behalf of the petitioners that the District Programme Officer, Sheohar has lodged a case against 20 persons on account of the fact that the petitioners were trying to persuade him to issue letter of promotion which stood supported by the orders passed by this Court in C.W.J.C. No. 13734 of 2012. It is submitted that only on account of their participation in trying to persuade the concerned Officials that he took extreme steps of involving the petitioners in the present case due to no fault of their own.

Considering the nature of allegation as stated in the petition filed by the District Programme Officer, Sheohar, let the petitioners above named in both the bail applications, in the event of arrest or surrender before the learned court below within a period of two weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sheohar in connection with Sheohar P.S. Case No. 24 of 2014 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure, 1973.
