The petitioner is languishing in custody in a case registered for the offences punishable under Sections 341, 323, 325, 307, 379, 504, 506, 34 of the Indian Penal Code and Section 27 of the Arms Act. The prosecution case as per F.I.R is that the petitioner along with other F.I.R named accused persons and 3-4 unknown stopped the informant in the background of hot exchange of talk between the

It is alleged against co-accused Kumod Kumar that he opened fire upon the informant causing injury and this petitioner along with other co-accused persons assaulted the informant with iron rod and snatched gold chain and cash of Rs. 25,000/- from the informant.
It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. There is general and omnibus allegation against the petitioner. The specific accusation of causing fire arm injury to the informant is against co-accused Kumod Kumar. The petitioner is languishing in custody since 23.03.2022.
In the facts and circumstance of the case, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-V, Saharsa in connection with Saharsa Sadar P.S. Case No.
