JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-376(D) of the Indian Penal Code and Section-6 of POSCO Act.

There is specific allegation of gang rape against the petitioner and the victim has supported the allegation in her statement, recorded under Section-164 of the Cr.P.C. Although learned counsel for the petitioner submits that the medical report does not support the allegation and in course of investigation, the witnesses have made contradictory statements but I am not, at all, convinced with the aforesaid submission.

Accordingly, this petition filed in connection with

Patna High Court Cr.Misc. No.46001 of 2016 (2) dt.22-10-2016 2/2 Harlakhi P.S. Case No. 99 of 2016 pending in the court of Learned Additional Sessions Judge-Ist, Madhubani stands rejected. However, learned trial court should expedite the trial of the petitioner and try to conclude the same as early as possible.
