JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-08-2019 This is an application for grant of anticipatory bail in connection with Obra P.S. Case No. 122 of 2019, disclosing offences under Sections 341, 323, 307, 504, 34 of IPC. Prosecution case is that petitioner and other accused persons assaulted the informant by Lathi and Danda and specific allegation against co-accused Rameshwar Mistri, due to which he became unconscious.

Submission of the learned counsel for the petitioners is that there is case and counter case between the parties and the injuries on the head was attributed by the accused Rameshwar Mistri about whom opinion was kept reserved.

Heard learned A.P.P. also.

Having heard both sides, considering the above

Patna High Court CR. MISC. No.53572 of 2019(2) dt.27-08-2019 2/2 submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned S.D.J.M. Daudnagar, Aurangabad, in connection with Obra P.S. Case No. 122 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
