Petitioners apprehend their arrest in a case registered for the offence punishable under Section 302 and some other allied Sections of the Indian Penal Code.
Petitioner No.1 is alleged to have assaulted the husband of informant with Lathi on his head.
Taking into consideration the fact that there is specific allegation of assault against petitioner No.1, I am not inclined to enlarge petitioner No.1 on anticipatory bail. Accordingly, his prayer is refused.
So far petitioner No.2 is concerned there is general
Patna High Court CR. MISC. No.68602 of 2021(2) dt.26-05-2022 2/2 and omnibus allegation against him of abusing and assaulting the husband of informant with fists and slaps. Petitioner No.2 has got clean antecedent.
Considering the facts of the case and clean antecedent of the petitioner No.2, let the petitioner No.2, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial MagistrateI, Darbhanga in connection with Jaley PS case No. 214/2019, subject to conditions laid down u/s 438(2) of the Cr. P. C. (Prabhat Kumar Singh, J) BKS/- U T
