The petitioner seeks bail in a case registered for offences punishable under Section 290 of the Indian Penal Code and Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 60 litres duplicate toddy and utensils were recovered from the shop of the petitioner. However, in the chemical analysis, no alcohol has been found in it. Petitioner claims that he is having clean antecedent and is in custody since 22.06.2017. Having regard to the facts and the circumstances of the case, the abovenamed petitioner is directed to be released

Patna High Court Cr.Misc. No.39850 of 2017(2) dt.25-08-2017 2/2 on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge (Excise Act), Muzaffarpur in connection with Town P.S. Case No. 753/16.

Further, if the petitioner, after his release in this case, is again found to be involved in similar nature of case then the court concerned would be at liberty to take steps for cancellation of his bail bond.
