The petitioners apprehend their arrest in connection with Obra P.S. Case No. 105 of 2019, registered under Sections 147, 149, 341, 323, 324, 307, 379 and 504 of the Indian Penal Code.

The accusation is that in the evening of 29.04.2019, due to land dispute Panchayati was arranged at the house of Satendra Sharma. In the meantime, Mohan Prasas, Kesari Devi (petitioner no.2), Ranjan Kumar, Raju Kumar, Sonu Kumar (petitioner no.1), Anil Prasad and one unknown started to cause assault to the informant and his brother, Sudarshan Prasad

Patna High Court CR. MISC. No.54116 of 2019(2) dt.28-08-2019 2/2 through Garasa, rod and stick. At that time, Mohan Prasad gave iron rod blow at the head of informant and his brother, in which, they sustained injury and fell down. When his daughter and sister-in-law came to save then they were also assaulted. In the meantime, petitioner no. 2 snatched gold chain from the neck of informant.

Learned counsel for the petitioners submits that while the petitioners are named in the F.I.R. but no specific overt act has been attributed against them and the petitioners have no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad, in connection with Obra P.S. Case No. 105 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
