NILU AGRAWAL ORAL ORDER 16-12-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

Petitioner is languishing in judicial custody since 28.06.2016 in connection with Singheshwar P.S. Case No. 69 of 2012 registered for the offence punishable under Section 379 of the Indian Penal Code.

The prosecution case is that while the informant went to attend the marriage at Pratima Singh Dharmshala and after returning he has found, his motorcycle was missing. It has been submitted by the learned counsel for the petitioner that he is innocent and has falsely been implicated in the aforesaid case. Charge sheet has also been submitted and there is

Patna High Court Cr.Misc. No.52337 of 2016 (2) dt.16-12-2016 2/2 no chance of tampering with the prosecution evidence. However, learned A.P.P. for the State submits that the name of the petitioner surfaced due to his confessional statement and motorcycle was recovered from the place of occurrence, hence opposes the prayer for bail.

Be that as it may, considering the facts and submission of the parties, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhepura in connection with Singheshwar P. S. Case No. 69 of 2012 with a condition that the petitioner is directed to appear before the learned Court below on each and every date and failure to appear before the Court below on two consecutive dates without assigning any reason will entail cancellation of his bail bond.
