The sole petitioner who is in custody since 17.7.2016 in Barh P.S. Case No. 234 of 2016 registered for the offence under Sections 20(b)(ii), 22/ 27 of the Narcotic Drugs And Psychotropic Substances Act, 1985 has prayed for grant of bail. It was submitted by learned counsel for the petitioner that petitioner was made accused on the basis of disclosure made by one of the co- accused namely Lakhan Modi. He submits that Lakhan Modi has already been granted bail by the court below itself. He has also argued that petitioner is having clean antecedent. This fact has been stated in paragraph no. 3 of the
Patna High Court Cr.Misc. No.42721 of 2016 (2) dt.08-12-2016 2/2 petition. Accordingly, a prayer has been made for grant of bail. Learned Additional Public Prosecutor has opposed the prayer for bail.
However, after going through the F.I.R. it is evident that petitioner was indulged in trafficking of Ganja and Charas and from his house on search besides Ganja and Charas of different weights weighing machine was also recovered. I do not find any ground to grant bail.
The petition stands dismissed.
