JUSTICE RAKESH KUMAR ORAL ORDER 19-08-2017 Heard Sri Pravin Kumar, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 27.03.2017 in Chakiya P.S. Case No.73 of 2017 registered for the offence under Sections 272, 273, 290 of the Indian Penal Code and Section 30(a) of the Bihar Excise ( Amendment ) Act, 2016, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that earlier the petitioner was never involved in any case relating to Excise Act, but in this case, recovery of about 8 liters of country-made liquor was shown from a hut , which was alleged to be of petitioner's hut.

Considering the nature of accusation and period of custody, let the petitioner, namely, Balindar Sahani be released on

Patna High Court Cr.Misc. No.39516 of 2017 (2) dt.19-08-2017 2/2 bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 13th , Motihari, East Champaran, in connection with Chakiya P.S. Case No.73 of 2017.
