Heard the learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest for the offences alleged under Sections 307, 323, 341, 379 and 448/34 of the Indian Penal Code, registered in connection with Rosera P.S.Case No. 45 of 2021.

As per allegation, the accused persons including the petitioner came to the shop of the informant. They asked to vacate it. The allegation against the petitioner is that he assaulted the informant on his head with butt of the pistol. They accused persons also snatched Rs. 18,250/- from the possession of the informant.

The learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.66169 of 2021(2) dt.25-07-2022 2/2 that he is innocent. The injuries sustained by the informant are simple in nature. He has submitted further that there is case and counter case and the petitioner lodged a case which was registered as Rosera P.S.Case No. 44 of 2021 under Section 307 and other sallied Sections of the Indian Penal Code. Considering the above facts and circumstances, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-1, Rosera at Samastipur in connection with Rosera P.S.Case No. 45 of 2021, subject to the conditions as laid down under Section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
