Injured, Upendra Sahni has alleged that on 17.03.2014 at 10:00 p.m., all the accused so named therein including the petitioner armed with Danda, Stick, Bhala etc. came and began to assault him. During course thereof, it has been alleged that Ashok Sahni (petitioner) gave Bhala blow causing injury over stomach (left side). It has also been alleged that Ashok Sahni and Jokan Sahni took away Rs. 10,000/-.
Taking into account the nature of injury sustained by Upendra Sahni, informant, all happens to be caused by hard and blunt substance, simple in nature (para-15 of the case diary) petitioner is directed to surrender before the learned trial court with a prayer for regular bail which the learned lower court will
Patna High Court Cr.Misc. No.40007 of 2014 (3) dt.09-04-2015 favourably consider in the background of nature of injuries referred above.
With the aforesaid observation, the instant petition for anticipatory bail is disposed.
