JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 07-11-2022 Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 498(A), 504, 506/34 of the Indian Penal Code and Section 3/4 of Dowry Prohibition Act.

The basic accusation is of torture for nonfulfillment of dowry demand. It is submitted on behalf of the petitioner that petitioner being the husband of the informant, has already filed a divorce case No. 140 of 2018 in the Family Court, Ghazipur, against the informant and in repercussion, the

It is admitted fact that informant is a bank employee and she is able to maintain herself. It is also submitted that petitioner is an unemployed person and divorce case is pending between them.

The learned counsel appearing on behalf of the informant has submitted that the informant is ready to live with the petitioner.

In view of the fact, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Buxar (Mahila) P.S. Case No. 63 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
