JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 272, 273, 420, 34 of the Indian Penal Code and SAection 47 Bihar Excise Act, 2016.

Although 133 litres country made as well as foreign liquor are said to have been recovered from a pick up van and petitioner was caught on the spot but according to the prosecution case itself, the driver-cum-owner of the aforesaid pick up van managed to flee away from there.

Submission on behalf of the petitioner is that petitioner does not have any concern either with the seized liquor or with the pick up van and, as a matter of fact, he had taken lift

Patna High Court Cr.Misc. No.47164 of 2016 (3) dt.08-12-2016 2/2 on the aforesaid vehicle while returning from Dalkola. Petitioner does not have any criminal antecedent and is languishing in jail custody since long.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M.-II,, Katihar in connection with Balrampur P.S. Case No.87 of 2016.
