2. The petitioner apprehends his arrest in connection with Bithan P.S. Case No. 48 of 2025, instituted under Section 30(a) of the Bihar Prohibition & Excise Act.
3. There is recovery of 20 litre country made liquor from Dharharwa Chaur. Petitioner managed to flee away from the spot.
4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. He is a student having clean antecedent. Petitioner was not present on the spot. Nothing has been recovered from the conscious possession of the petitioner. Petitioner has no concern with the seized liquor. Recovery has been made from an open place. There

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

Considering the facts and circumstances of the case and submission of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Judge1st, Samastipur in connection with Bithan P.S.
