The petitioner apprehends his arrest in a case registered for the offence under Sections 341, 323, 379, 504, 506, 308/34 of the Indian Penal Code.

As per the prosecution case, on 22.04.2021 at about 4:30 PM, while the informant was at home, all the FIR named accused including this petitioner, variously armed, came there and started abusing informant and on protest, they assaulted informant and his wife. This petitioner is alleged to have assaulted with iron rod on the head of informant, as a result of which, bleed started oozing out from his head. It is submitted on behalf of petitioner that petitioner is innocent and has been falsely implicated due to previous dispute. He is government employee and has got no concern with the alleged occurrence. Police after investigation submitted final form against petitioner and chargesheet was submitted

Patna High Court CR. MISC. No.67068 of 2021(2) dt.24-05-2022 2/2 against other co-accused persons, but differing with the same, the learned court below has taken cognizance against petitioner. Petitioner claims clean antecedent.

Learned A.P.P. for the State has opposed the bail petition.

Considering the fact that petitioner is government employee and has got clean antecedent, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. I, Hilsa, Nalanda / concerned court in connection with Telhara P.S. Case No. 60 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
