JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-302, 120(B) of the Indian Penal Code and 27 of the Arms Act.

Petitioner and one Bhagwan Jha are said to have rained bullets on the deceased, as a result of which, the deceased died then and there.

Although learned counsel appearing for the petitioner submits that the informant is not an eye witness of the alleged occurrence and in course of investigation, the aforesaid fact has emerged, but I am not, at all convinced with the aforesaid submission.

Regard being had to the facts and circumstances as

Patna High Court Cr.Misc. No.46166 of 2016 (2) dt.22-10-2016 2/2 well as submission of the parties, the prayer for bail of the petitioner in connection with Bihra P.S. Case No. 57 of 2016 stands rejected.
