The petitioners seek regular bail in Kahalgaon (Ghogha) P.S. Case No.450 of 2016 registered for the offence under Sections 147, 149, 448, 342, 323, 379, 504, 506 and 302 of the I.P.C.

Earlier prayer for bail of the petitioners has been rejected vide Annexure-1/A with observation that he may renew after framing of charge.

Submission of the learned counsel for the petitioners is that now charge has been framed in this case and petitioners are in custody since 22.04.2017 and ready to abide by the conditions imposed on him Heard learned A.P.P. also who opposed the

Patna High Court Cr.Misc. No.44862 of 2017 (2) dt.20-09-2017 2/2 prayer for bail.

Having heard both sides and in view of the earlier observation, let the petitioners, above named, be enlarged on bail on furnishing bail bonds of Rs.25,000/- each with two sureties of the like amount each to the satisfaction of 3rd Additional Sessions Judge, Bhagalpur, in Sessions Trial No.700/17 arising out of Kahalgaon (Ghogha) P.S. Case No.450 of 2016 subject to the conditions that (1) one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned court. (2) The petitioners will not induce any witness or tamper with the evidence.

(3) The petitioners shall co-operate in disposal of trial and make himself available as and when required by the court. In the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reason, his bail bond shall be cancelled.
