In pursuance to the direction of this Court, a report with regard to the present stage of the trial has been received which has been kept at Flag-R.

The report of learned 21st Additional Sessions Judge, East Champaran, Motihari dated 21.03.2023 suggests that out of nine prosecution witnesses, eight witnesses have already been examined and only I.O is yet to be examined for which summon has already been issued for his appearance.

Accordingly, the petition is dismissed as withdrawn.

The Trial Court is directed to expedite the trial and conclude the same within a period of three months from today.

The petitioner is at liberty to approach this Court for grant of bail, if the trial is not concluded within three months.
