This application is for grant of regular bail in connection with Dulhin Bazar P.S.Case No.236 of 2016 S.Tr. No.457 of 2017 , registered for the offences punishable under Section 395 the Indian Penal Code.

Petitioner is not named in the FIR and his name transpired during the course of investigation of the case on confession of the co-accused. It further appears from perusal of the record that he is accused in seven other cases also. Submission of the learned counsel for the petitioner is that except confession there is nothing against the petitioner, there is no recovery andhe has not been put on TIP. The petitioner is in custody for about six months. It has also been submitted that the

Heard learned A.P.P. also, who has opposed the prayer for bail on the ground of criminal antecedent of the petitioner.

Having heard both sides and in view of allegation as well as criminal antecedent of the petitioner, this application is disposed of with direction to the learned court below that if the charges have been framed in this case, he will release the petitioner on bail bond of Rs.25,000/- in connection with S.Tr. No.457 of 2017 (arising out of Dulhin Bazar P.S.Case No.236 of 2016) with condition that till conclusion of the trial of this case, he will make his attendance before the concerned Police Station of the area in the first week of every month as well as cooperate in the investigation of the case and make himself available as and when required by the police, otherwise, the prosecution is free to move for cancellation of his bail bond. With the aforesaid observation, this application is disposed of.
