JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 12-09-2019 Heard learned counsel for the petitioners and learned learned Additional Public Prosecutor for the State. The petitioners are in custody in connection with Lakhisarai P.S. Case No. 211 of 2019 for the offenses under Sections 395 and 397 of the Indian Penal Code and Section 3⁄4 of Explosive Substances Act.

The allegation against the petitioners is that on the point of pistol they have looted Rs. 2 lacs cash, golden and silver ornaments.

Learned counsel for the petitioner submits that petitioner No. 1 has no criminal antecedent and the petitioner No. 2 is accused in another case. The petitioners are in custody

Patna High Court CR. MISC. No.57051 of 2019(2) dt.12-09-2019 2/2 since 24.03.2019. Counsel further submits that the FIR was lodged against unknown yet the petitioners have not been put on Test Identification Parade.

Considering the aforesaid, the court is inclined to grant bail to the petitioners. Let the petitioners, above named, be enlarged on bail on furnishing bail bond of Rs. 1,00,000/-(One lac) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Lakhisarai in connection with Lakhisarai P.S.
