The petitioner is languishing in custody since 11.02.2015 in a case registered for the offences punishable under Sections 385, 387 of the Indian Penal Code and under section 17 C. L. A. Act.
. The prosecution case is against the owner of mobile Number 8485833860 on the basis of written report of the informant Durga Devi. It is alleged in the F.I.R. that on 5.2.2015 at 6.11. P.M. her husband received a call on his Mobile No. 9430421218 from Mobile No. 8485833860 and asked him that have you received any letter on which he denied. Again on 6.2.2015 at 8.33 A.M., her husband received another call and the
Patna High Court Cr.Misc. No.29164 of 2015 (2) dt.05-08-2015 2/2 caller told him that letter was in your office. The informant searched the letter and found the same in which Rs. 10 lacs was demanded as rangdari by Lal Salam and threateningwas also given in the said letter. It has been alleged that the informant's husband had applied for the licence of arms, which has not yet been received.
The petitioner claims that he has not been named in the F.I.R. but during course of investigation his name figured on the confession of co-accused Md. Chand.
Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Runnisaidpur P.
