JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 18-10-2017 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in connection with Sidhwalia P.S. Case no. 107 of 2017 registered for the offence punishable under Sections 379 and 411 of the Indian Penal Code. The petitioner is said to have stolen bicycle of the informant parked outside of the studio.

It is submitted by the learned counsel for the petitioner that no such occurrence as alleged ever took place. As a matter of fact, an altercation took place between the petitioner and the proprietor of the studio regarding the quality of the photo and the said proprietor with the help of informant caught hold the petitioner and falsely implicated in the case. The petitioner has been languishing in custody since 10.08.2017.

Patna High Court Cr.Misc. No.50448 of 2017 (2) dt.18-10-2017 2/2 Considering the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Sidhwalia P.S. Case no. 107 of 2017.
