The petitioner seeks bail in a case registered for the offences punishable under Sections 406, 409 and 420 of the Indian Penal Code.

The petitioner lifted 4000 quintals of paddy for milling in the year 2013-14 and the petitioner had to deliver 2680 quintals of rice, price of which comes to Rs. 66,42,540.80/-. It is submitted that the petitioner deposited Rs. 5,00,000/- guarantee and also mortgaged his immovable property worth Rs. 1,46,00,000/-. The corporation may realize the aforesaid amount from the bank guarantee as well as the pledged property. The petitioner is in jail since 14.06.2015.

Considering the facts aforesaid and the fact that the case

Patna High Court Cr.Misc. No.29638 of 2015 (2) dt.11-08-2015 2/2 is of breach of contract and for that the petitioner has already pledged his property more than the amount of misappropriation, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhabua in Chand P.S. Case No. 12 of 2015.
